Kampo Ni Debbie Garcia Mag-aapela Sa Desisyon Ng Fiscal

 Naglabas ng saloobin ang kampo  ng VivaMax actress na si Debbie Garcia tungkol sa napapaulat na resolution mula sa piskalya kung saan ibinasura ang mga reklamo niya laban sa Kapamilya actress na si Barbie Imperial.

Matatandaan noong October nang nagdaang taon, kumalat ang mga CCTV footages kung saan makikita ang pag-aaway nina Debbie Garcia at Barbie Imperial.

Ipinakita pa noon ni Debbie Garcia ang mga kalmot na natamo niya dahil sa panunugod umano ni Barbie Imperial sa kanya. Agad siyang nagpa-blotter at nagsampa ng mga reklamong slight physical injury, grave oral defamation, at grave slander by deed.

Samantala, kamakailan lamang ay inilabas ni Ogie Diaz sa isang episode ng kanyang vlog ang umano'y desisyon ng Fiscal na pagbabasura sa mga sinampang reklamo ni Debbie Garcia laban kay Barbie.

Ayon sa resolution, lumalabas sa kanilang imbestigasyon ang kakulangan ng mga ebedensyang nagpapatunay na ginawa ni Barbie Imperial ang mga kasong inirereklamo ni Debbie Garcia.

“WHEREFORE, in view of the foregoing, the undersigned finds that the charges against the Respondent Barbie Imperial y Concina, alias “Barbie Imperial” for Slight Physical Injuries under paragraph 1, Article 266 of the Revised Penal Code, Grave Oral Defamation under Article 358 of the Revised Penal Code and Grave Slander by Deed be DISMISSED due to INSUFFICIENCY OF EVIDENCE.”

Samantala, nagbigay na ng saloobin ang legal council ni Debbie Garcia na si Atty. Catherine Amen, wala pa silang natatanggap na kopya ng resolusyon na gaya nang ipinakita sa vlog ni Ogie Diaz.

Ayon pa sa official statement na ibinahagi nito abogado, “under review” pa ang mga reklamong inihain nila laban sa Kapamilya actress. 

“We watched Mr. Ogie Diaz’ vlog about the dismissal of my client’s case against Ms. Barbie Imperial. “Please know that we have yet to receive a copy of the Resolution. 

"So, we do not know the veracity of the resolution cited in the said vlog. The last time we checked, we were informed by the staff of the investigating prosecutor that the case was still under review.

“What we are actually waiting for is an Order on the undated Motion to Reopen the Case filed by Ms. Imperial since the case was already submitted for resolution without her filing any responsive pleading. 

"She filed said motion so she can file her Counter-Affidavit which she did not file when subpoenaed to do so. As a matter of fact, Ms. Imperial failed to attend any hearing during the preliminary investigation of this case before the Investigating Prosecutor. We opposed the motion by filing our Comment/Opposition; hence, the anticipation of such Order.

“However, if that was indeed the resolution issued, we will be filing the necessary pleading before the Office of the City Prosecutor of Quezon City."

Dagdag pa nito na may nakuha na silang third party na magpapatunay sa mga testimonya ni Debbie Garcia.

“We know we have a strong case against Ms. Imperial based on the testimonial and object evidence we submitted to the investigating prosecutor.

"We have third persons who willingly testified as to the truth of the incident, we also have 2 CCTV footages covering two separate instances of Ms. Imperial’s infractions. 

"We also submitted one video interview, which we believe substantiated all the allegations in the complaints. With these and more, we are confident that my client will get the justice she deserves.”
